Negligence is the lack of ordinary care. It is a failure to use that degree of care that a reasonably prudent person would have used under the same circumstances.

Negligence requires both a reasonably foreseeable danger of injury to another and conduct that is unreasonable in proportion to that danger. There is negligence if a reasonably prudent person could foresee injury as a result of his or her conduct, and acted unreasonably in the light of what could be foreseen.

A negligent act or omission is regarded as a cause of an injury only if it was a substantial factor in brining about the injury, that is, if it had such an effect in producing the injury that reasonable people would regard it as a cause of the injury.
